I refer to your request for information received on 23 January 2023. Please see the information below in response to your request: -

Under the The Freedom of Information Act please can you send me the contractors, sub contractors and suppliers working on the regeneration of Winstanley & York Road Estates regeneration?

Our Response:

The Winstanley and York Road scheme is being delivered by a Joint Venture with Taylor Wimpey. Should the information requested be provided, it could be used by third parties to affect the joint venture's ability to procure in a competitive way. Therefore, these details are both confidential and commercially sensitive (exempt from disclosure under Section 41 - Information provided in confidence and Section 43 - Commercial Interests of the Freedom of Information Act 2000).

Disclosure of this requested information is likely to prejudice the commercial interest of the joint venture, as it could weaken their position in a competitive market by placing market sensitive information in the public domain, and to which other companies might refer should the Council decide to negotiate with other providers in the future. Disclosure would also be likely to prejudice the Council's ability to secure the best possible value for any future contracts, as companies may be unwilling to provide the full information required if they believe this will be disclosed to competitors.

This exemption requires the Council to consider the public interest test and, whilst the Council recognises the public interest in the transparency of the procurement process, it must consider the strong public interest in securing best value for taxpayers. In addition it could be considered that some of the information is provided on a confidential basis on the understanding that it will not be placed in the public domain. As a consequence, the greater public interest lies in withholding these parts of the requested information.

Under the terms of the Act, this email acts as a Refusal Notice.
