Subject: Enforcement Activities

1. Does the Council deliver on-the-ground enforcement functions such as issuing fixed penalty notices for anti-social behaviour, littering and flytipping, and if so, how (directly, contracted out, etc.)?

2. Does the Council deal with abandoned and/or untaxed vehicles, if so, how?

3. Does the Council deal with unlawful encampments and traveller incursions, if so, how?

4. If yes to either 1, 2 or 3, does an enforcement strategy exist, and can this be provided?

5. In the last 5 financial years, how much has your authority recovered through Fixed Penalty Notices, fines and other actions as a result of enforcement action for these activities?

6. In the last 5 financial years, how much has been spent on delivering these enforcement activities (for ease, if these form the substantive part of a department or team's responsibilities, please provide its combined net revenue budget)?

7. Please provide any internal email correspondence and documents (including service reviews and committee reports) which relate to any consideration of reviewing expenditure on the aforementioned enforcement functions within the last 2 years.

Request for Information - WBC-FOI-00414 - Enforcement Activities

I refer to your request for information received on 13 January 2023. Please see the information below in response to your request: -

1.Does the Council deliver on-the-ground enforcement functions such as issuing fixed penalty notices for anti-social behaviour, littering and flytipping, and if so, how (directly, contracted out, etc.)?

Wandsworth Council's Highways department cover littering and fly tipping, both in-house staff and contracted out.

2.Does the Council deal with abandoned and/or untaxed vehicles, if so, how?

Abandoned vehicles only, Wandsworth Council do not have any jurisdiction over tax issues, these are referred to the DVLA to resolve. Reports received by residents we carry out investigations to find any owner, if none found and the vehicle meets our criteria, we will arrange removal and destruction. We have no holding facilities and we can only remove under the refuse disposal amenity act (1978) as refuse on the highway. If claimed during this process, we will not remove, this then becomes a DVLA matter (as untaxed).

3.Does the Council deal with unlawful encampments and traveller incursions, if so, how?

Only for 3 above.

2017/18: £67440.00

2018/19: £56530.00

2019/20: £142900.00

2020/21: £184,389.88

2021/22: £162,664.93

6. In the last 5 financial years, how much has been spent on delivering these enforcement activities (for ease, if these form the substantive part of a department or team's responsibilities, please provide its combined net revenue budget)?

Wandsworth Council's enforcement team have multiple functions and do not just investigate littering and fly tipping. They also provide enforcement for all highway offences. It is therefore not possible to provide a figure.

7.Please provide any internal email correspondence and documents (including service reviews and committee reports) which relate to any consideration of reviewing expenditure on the aforementioned enforcement functions within the last 2 years.
