Weighting of adopted and emerging policy

From 20 October 2010 the adopted Development Plan for the borough will consist of the London Plan, the Core Strategy and the Unitary Development Plan (see below re superseded policies).

 

The Core Strategy was found sound by an independent Planning Inspector in June 2010, and was adopted by full Council on 20 October 2010. The UDP policies listed in Appendix 3 of the Core Strategy have been superseded and will no longer be a material consideration in planning decisions. Appendix 3 also includes policies which were not saved following a review of policies in the UDP by the Secretary of State, and therefore expired on 27th September 2007.

 

At their meeting of 09 May 2011, the Executive approved the use of the Development Management Policies Document (DMPD) and Site Specific Allocations Document (SSAD) Submission Versions as material considerations in the assessment of planning applications from the date of submission of the documents to the Secretary of State (27 May 2011).   The Inspector's report into the Examination of the documents was received on 15 December 2011, and the documents were found sound.  

 

In accordance with advice from Communities and Local Government and as set out in Planning System - General Principles document (which accompanies Planning Policy Statement 1: Delivering Sustainable Development) the weight to be attached to emerging DPD policies depends upon the stage of preparation or review, increasing as successive stages are reached. Given that the DMPD and the SSAD have now been found sound, the policies in these documents will be given substantial weight in the assessment of applications and will be quoted as such in Committee reports. Where policies in the both DMPD/SSAD and the UDP apply, e.g. house conversions, both will be quoted (in addition to any relevant Core Strategy policies), and where there is any conflict between the policies, the DMPD/SSAD policy will take precedence and will be used to inform the recommendation.
