Exemptions to the regulations
There are a number of exemptions from the requirements of the regulations.
These include:
- Private homes (except common areas and where used for work purposes by more than 1 person and whether they live there or not)
- Designated bedrooms in hotels, guest houses, inns, hostels, members clubs
- A designated room for accommodation for a person over 18 years, such as care homes, hospices and prisons.
- Some Performers
- Specialist tobacconists
- Offshore installations
- Research and testing facilities
- Temporary exemption for Mental Health facilities until July 1, 2008.

Residential accommodation
The smoking ban will also apply
to communal areas such as lifts, lobbies and kitchens within residential
accommodation, such as the entrance lobby to a block of flats or a kitchen used
by those living in bed sits. All landlords/owners will also have to display the
"no smoking" signs.
