Which premises are smoke-free?
If your premises are enclosed or substantially enclosed and fall in to one of the following three groups:
- are open to the public, or
- are used as a place of work by more than one person, or
- where members of the public might attend,
then your premise will have to be Smoke-free.
Premises are "enclosed" if they have a ceiling or roof, and except for windows, doors or passageways are enclosed on a permanent or temporary basis.
Premises are "substantially-enclosed" if they have a ceiling or roof, but there are permanent openings in the walls which are less than half of the total areas of walls. Therefore, if 50% or more of the walls are missing then you can use that area for smoking.
A "roof" includes any fixed or moveable structures such as canvas awnings.
Tents, marquees or similar constructions will be classed as "enclosed" premises if less than 50% of the walls are permanently open. The side panels of tents/marquees will be classed as rolled down, even when they are rolled up.
Vehicles also have to be smoke-free if they are:
- used by members of the public whether or not for reward or hire, or
- used for paid or voluntary work by more than one person at any time, and
- the vehicle is "enclosed".
If a vehicle has a roof which can be removed, the vehicle must be smoke-free when it is wholly or partly covered by the roof.
A vehicle does not have to be smoke-free when the roof is stowed away and does not cover any part of the compartment when people are travelling in it.
Privately owned vehicles do not have to be smoke-free where it is used by the owner for their private use or the person has no restrictions on the usage.

- Church halls

- Communal/shared areas in residential accommodation
- Delivery vehicles
- Libraries
- Minicabs
- Nightclubs
- Offices
- Private members clubs
- Public service vehicles
- Restaurants
- Schools
- Shopping centres
- Sports centres
- Taxis
- Theatres
