Changes to Permitted Development Rights

Permitted Development (or Permitted Development Rights)
Permission to carry out certain development (for example single storey rear extensions) without the need to make a planning application to Council.

When are permitted development rights removed?
Permitted development rights are generally removed in one of two ways:

Either by the issuing of a condition on a development to restrict further extensions or alterations. This is known as an Article 3 Direction, and may often be found on post 1960's housing developments and sometimes on properties that may have been previously extended. Another example might be where a house has an attached or integral garage. The use of the garage may be limited. To check on such conditions you are advised to check the Planning History of your property. You can do this by searching our Tell Me About My Property pages.

Or an Article 4 Direction. This is a Direction removing some or all permitted development rights, for instance the removal of front boundary walls within a conservation area.

Dover House Estate Conservation Area
The Article 4 direction means that the following changes need planning permission:

  1. External alterations to houses which would be visible from the street; i.e. all front elevations and some side and rear elevations; this includes the replacement of windows and doors.
  2. Changes to the roofs of houses; including re-roofing in a different material.
  3. Building porches at the front of the house.
  4. Laying out hard surfaced areas, e.g. for car parking within the front and some side garden areas of houses.
  5. Building walls, fences or gates on front boundaries, which face a road or footpath.
  6. Demolition of buildings and some front boundaries*.
  7. Painting the outside walls of houses and flats, except the painting of rough- cast or render in one of the approved colours, light beige, cream or off - white.

*(Front boundaries over 1 metre in height).

Heaver Estate Conservation Area
The Article 4 direction means that following changes need planning permission:

  1. External alterations to houses which would be visible from the street; i.e. all front elevations and some side and rear elevations; this includes the replacement of windows and doors.
  2. Changes to the roofs of houses; including re-roofing in a different material.
  3. Building porches at the front of the house.
  4. Laying out hard surfaced areas, e.g. for car parking within the front and some side garden areas of houses.
  5. Building walls, fences or gates on front boundaries, which face a road or footpath.
  6. Demolition of the front boundary or demolition of buildings.
  7. Painting the outside walls of houses and flats.

Latchmere Estate
The Article 4 direction means that the following changes need planning permission:

  • External alterations to houses which would be visible from the street; i.e. all front elevations and some side and rear elevations; this includes the replacement of windows and doors.
  • Changes to the roofs of houses; including re-roofing in a different material.
  • Building porches at the front of the house.
  • Extensions to the house.
  • Building walls, fences or gates on front boundaries, which face a road or footpath.
  • Painting the outside walls of houses and flats.
  • Demolition of buildings and some front boundaries*.

*(Front boundaries over 1 metre in height).

Putney Lower Common Conservation Area Article 4 Direction(15 - 36 Commondale)
The Article 4 direction means that the following changes need planning permission:

  1. External alterations to houses which would be visible from the street; i.e. all front elevations and some side and rear elevations; this includes the replacement of windows and doors.
  2. Changes to the roofs of houses; including re-roofing in a different material.
  3. Building porches at the front of the house.
  4. Laying out hard surfaced areas, e.g. for car parking within the front and some side garden areas of houses.

  6. Demolition of the front boundary or demolition of buildings.

  5. Building walls, fences or gates on front or boundaries, which face a road or footpath.

Shaftesbury Park Estate Conservation Area

Wandsworth Common Conservation Area Article 4 Direction No.1
(11 - 21 Westover Road)
The Article 4 direction means that the following changes need planning permission:

  1. Demolition of part or whole of the front boundary
  2. Building walls, fences or gates on front or boundaries, which face a road or footpath.

Wandsworth Common Conservation Area Article 4 Direction No.2
(23 - 67 Westover Road)
The Article 4 direction means that the following changes need planning permission:

  1. Demolition of part or whole of the front boundary
  2. Building walls, fences or gates on front or boundaries, which face a road or footpath.
  3. Laying out hard surfaced areas, e.g. for car parking within the front garden.

(Demolition of buildings will require Conservation Area Consent regardless of the Article 4 Direction)

  2. Building walls, fences or gates on front or boundaries, which face a road or footpath.
  3. Laying out hard surfaced areas, e.g. for car parking within the front/side garden.
  4. External alterations to buildings which would be visible from the street; i.e. all front elevations and some side and rear elevations; this includes the replacement of windows and doors.
  5. Any changes to the roofs of building; including re-roofing in a different material.
  6. Building porches at the front of the building.
  7. Painting the outside walls of houses and flats.

(Demolition of buildings will require Conservation Area Consent regardless of the Article 4 Direction)

Wandsworth Common Conservation Area Article 4 Direction No.5
(1 - 29 Rosehill Road, 2 - 18 Rosehill Road, 32 - 46 Rosehill Road) The Article 4 direction means that the following changes need planning permission:

  1. Demolition of part or whole of the front boundary.
  2. Laying out hard surfaced areas, e.g. for car parking within the front/side garden.

(Demolition of buildings will require Conservation Area Consent regardless of the Article 4 Direction)
