Transitional Protection

Transitional Protection will apply unless a tenant is better off under the new scheme, in which case they will have the increased rate used in their benefit calculation from 7 April 2008.

If you received LHA prior to 7 April 2008 Transitional Protection will mean that the changes to the Local Housing Allowance rules will not affect you for the first year unless:

  • You have a break in claim
  • You change address

Transitional protection may also be affected if:

  • You have a change in circumstance due to a change in the size of your household
  • If transitional protection ends any benefit entitlement will be calculated under the new rules.

If you received LHA prior to 7 April 2008, you will not be affected by the £15 cap on the amount of LHA used in your benefit calculation, until April 2009, unless there is a change in your circumstances.
